1. About these terms

These Terms and Conditions govern how you use the Susy Jewelry website (the "Site") and any purchase you make through it. In these terms, "we", "us" and "our" refer to Ventaro LLC, the company that runs Susy Jewelry, and "you" refers to anyone who visits the Site or places an order.

By using the Site or placing an order you accept these terms, together with our Privacy Policy, Shipping and Delivery policy, Return and Refund policy and Payment Policies. If you do not accept them, please do not use the Site or order from us.

2. Who can order

You confirm that you are at least 18 years old, that you are able to enter into a legally binding contract, and that nothing in the law or in another agreement stops you from doing so.

When you place an order you are offering to buy the items in your cart on these terms. You confirm that you have read them and that the details you give us are accurate and complete. We may deny access to the Site where we consider it necessary or appropriate.

3. Personal use only

Our products are for your own personal, non-commercial use. You buy as an individual customer and not on behalf of anyone else, and you may not resell our products without our written permission.

4. Products and prices

We do our best to describe and show our products accurately. Colors, plating and the look of stones can differ a little from what appears on your screen. The pictures on the Site are illustrative renderings created with AI and are marked as such. Our pieces are gold-plated and silver-plated jewelry, meaning a thin layer of plating over a base metal and not solid gold or silver. Pearls described as imitation are not natural or cultured pearls, and stones described as synthetic, cubic zirconia or opal-style are not natural gemstones.

Prices are in U.S. dollars. Standard shipping inside the United States is free on eligible orders, and any sales tax that applies is shown at checkout before you pay.

If we find a mistake in a price or description, we will let you know as soon as we can and offer you the choice of keeping the order at the correct price or cancelling it with a full refund. We do not have to fulfil an order placed at a wrong price, even if we have already sent a confirmation. Prices can change, but a change does not affect an order we have already confirmed.

5. How orders work

Every order depends on availability. A contract between you and us exists only once we send an order confirmation, and only for the products named in it.

If you order several products, they may be delivered separately. If something turns out to be unavailable, we will email you and refund what you paid for it.

We can decline or cancel an order at any point, even after confirming it, for example where we suspect fraud, an item is out of stock, or we cannot deliver to your address. If we cancel an order you have paid for, you get a full refund.

6. Payment

You can pay with the methods offered at checkout, including major credit and debit cards, Apple Pay and Google Pay. Third-party payment providers process payments, and you agree that we may pass them the information needed to do so.

You confirm that the payment method belongs to you and has enough funds or credit available. We are not responsible for problems caused by your bank, your card issuer or a payment provider.

If something goes wrong with an order, please contact us first at the email address below so that we can put it right. This does not affect any rights you have with your card issuer or under the law.

7. Delivery

We deliver only to addresses in the United States. Orders are processed Monday to Saturday, and delivery is estimated at 3 to 6 business days from the order date. Those times are estimates and not guarantees.

Please check your delivery address before paying. The products are at your risk from the moment they are delivered to the address you gave us. If delivery is late or fails because of something you did or failed to do, we may charge reasonable costs for returning or re-sending the order where the law allows.

To the fullest extent the law allows, we are not responsible for delays caused by carriers, the weather or other events outside our reasonable control. More detail is in our Shipping and Delivery policy.

8. Changing or cancelling an order

To change or cancel an order, email support@jewelry-susy.com as soon as possible and include your order number. We can normally only do this before the order has gone into processing. Once it has been packed or shipped it can no longer be changed or cancelled, but you can return it after it arrives under our Return and Refund policy.

9. Returns, refunds and faulty items

Unused pieces can be returned within 30 days of delivery in their original condition and with proof of purchase. Start by sending the return request form, and we will reply by email with the return address and instructions. Returns are shipped to China. You pay return postage unless the item arrived damaged or we sent the wrong piece. After we receive and check the return, the purchase price is refunded to the original payment method.

If a product arrives faulty, damaged or different from what you ordered, send a return request within 7 days of delivery, with photos and your order number. We will choose whether to replace the product or refund its price, and we pay the return postage where the fault is ours.

10. Discount codes and promotions

Discount codes and promotions have to be entered at checkout, only one can be used per order unless we say otherwise, and they have no cash value. If you return an order that used a code, the value of the code is not refunded.

11. Acceptable use

You may not use the Site in a way that is unlawful, fraudulent or harmful, or that damages the Site or gets in the way of anyone else using it. In particular, you must not: (a) scrape, harvest or mine data from the Site, or access it with bots or other automated tools, without our written consent; (b) introduce viruses or other harmful code, or try to get unauthorized access to the Site, our servers or any connected system; (c) copy, change, reverse engineer or create works based on the Site's code or content; (d) use information from the Site to market to or contact other people; (e) place false, speculative or fraudulent orders; or (f) give information that is untrue, misleading or that infringes someone else's rights.

You are responsible for any loss we suffer because you broke this section. Please tell us if you notice any activity on the Site that breaks these terms.

12. Links to other websites

The Site may link to websites run by others. Those links are provided for information and do not mean we endorse the sites. We do not control them and are not responsible for what they contain or how they operate. You may link to our home page if you do so fairly and lawfully and without suggesting that we endorse you.

13. Intellectual property

We own, or hold a licence for, all intellectual property in the Site and its content, including text, pictures, graphics, the Susy Jewelry name and logo, and the Site's code and design. You may use the Site and its content only for your own personal, non-commercial purposes, and you may not use our trademarks or content without our written permission first.

14. Privacy and cookies

Our Privacy Policy explains what personal information we collect and how we use it, including through cookies, and it forms part of these terms. By using the Site you confirm that you have read it.

15. Security and viruses

We cannot promise that the Site will always be secure, available without interruption or free of errors and viruses. You are responsible for setting up your own devices and for running your own protection software. If we believe you have broken this section, your right to use the Site ends immediately and we may report the matter to the authorities.

16. Disclaimers and limits on liability

The Site and its content are provided "as is" and "as available". As far as the law allows, we exclude every warranty that these terms do not expressly give, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

As far as the law allows, we are not liable for indirect, incidental, special or consequential loss, or for lost profit, business, goodwill or savings, even where the loss could have been foreseen. Our total liability to you in connection with these terms or any purchase is limited to the amount you paid for the product that the claim relates to.

Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud or for death or personal injury caused by negligence. Some states do not allow certain exclusions or limits, so parts of the above may not apply to you, and you may have other rights that differ from state to state.

17. Indemnity

You agree to protect and hold harmless Ventaro LLC, its affiliates, and their officers, employees and agents from claims, losses and reasonable expenses that arise from your material breach of these terms, your fraud or misconduct, or your misuse of the Site.

18. Events outside our control

We are not responsible for a delay or failure that results from events beyond our reasonable control, such as natural disasters, fire or flood, war, terrorism, pandemics, strikes, power or telecoms failures, failures by carriers or suppliers, or a new law or government order. The time we have to perform is extended for as long as the event continues. If it lasts longer than a week, we may cancel the affected order and refund anything you paid for products that were not delivered.

19. Suspension and ending of access

You can stop using the Site whenever you like. We may suspend or end your access, refuse orders, or block your device if you break these terms or if your use of the Site could expose us to legal risk or disturb others. We may also change, suspend or withdraw all or part of the Site at any time. Parts of these terms that are meant to continue after access ends, such as those on liability, indemnity and governing law, remain in force.

20. Updates to these terms

We may revise these terms from time to time. The version shown on this page when you place your order is the one that applies to that order. If you disagree with a change, please stop using the Site.

21. General

You may not transfer your rights under these terms to anyone else. If a part of these terms is found to be unenforceable, the rest stays in force. If we do not enforce a right immediately, we have not given it up. These terms are an agreement between you and us only, and nobody else may enforce them. Together with the policies named above, they are the whole agreement between you and us about the Site and your purchases.

22. Governing law and disputes

These terms, and any dispute connected with them, are governed by the laws of the State of Wyoming and applicable U.S. federal law, without regard to conflict-of-law rules. Before starting any formal proceeding, please email support@jewelry-susy.com so that we can try to settle the matter informally. A dispute that cannot be settled informally will be brought in the state or federal courts located in Wyoming, and you and we both accept their jurisdiction.
